Stormwater Regulatory History and Background

In 1972, the United States Congress passed the Water Pollution Control Act with the purpose to restore and maintain the quality of our nation's water. The Water Pollution Control Act was amended in 1977 and re-titled the Clean Water Act. This established the National Pollutant Discharge Elimination System (NPDES) Program.

To address this issue, stormwater discharge regulations have been implemented by a two-phase approach. Cities regulated under Phase II are required to obtain permit coverage under the Stormwater Discharge General Permit. State and Federal regulations require that Phase II cities develop, implement and enforce a Stormwater Management Program designed to reduce the discharge of pollutants. As part of the Stormwater Management Program, best management practices will be established for each of the required six minimum control measures:

  • Public Education and Outreach 
  • Public Involvement/Participation 
  • Illicit Discharge Detection and Elimination 
  • Construction Site Stormwater Runoff Control 
  • Post-Construction Stormwater Management in New Development and Redevelopment 
  • Pollution Prevention/Good Housekeeping for Municipal Operations
