On Monday, March 30 the City and County of Broomfield filed a motion requesting the courts reconsider a Temporary Restraining Order (TRO) granted to Extraction Oil and Gas on March 27. The TRO prohibits Broomfield from issuing a Public Health Order suspending oil and gas flowback operations at the Livingston Pad for the duration of the state’s stay at home order.
Extraction Oil and Gas has now filed a complaint.
A hearing on the preliminary injunction motion is scheduled for April 8.
The Board of Health directed Broomfield attorney’s and Public Health Director to draft the Public Health Order Wednesday, March 25. If the order was issued then, the TRO would have prevented the order from being enforced.
